Legal terms and conditions for the "Design your own bag" promotion

1.- COMPANY ORGANIZING THE PROMOTION
The company Actuando 2012 S.L.U, with registered office at Avda. Carlos Cano n° 4 Ubrique (Cádiz) 11600, with Tax ID number B72233745 and email address contacto@funandbasics.com, is organizing a promotional giveaway (hereinafter, "the Promotion") to be held online via its Instagram profile, exclusively for residents of Spain, in accordance with the provisions of the section on conditions of participation.

2.-START DATE AND END DATE
The Promotion will begin on March 18 at 6:00 p.m. (Spanish time zone) and end on March 29 at 2:00 p.m. The winner will be announced on Monday, March 30.

3.- PARTICIPATION REQUIREMENTS AND PROMOTION MECHANICS
The participation requirements are as follows:
Be a resident of Spain
Be a follower of the user @funandbasics
Share the design in a story tagging funandbasics.

– Anyone who follows @funandbasics or is already a follower and uploads a story with their design can participate.

4.- PROMOTION TERMS AND CONDITIONS AND PRIZES
One winner and three alternates will be chosen from among all participants based on the selection criteria of the funandbasics design team.

Prize The prize consists of having the design featured in a future funandbasics collection and a gift basket valued at €100.

The winner will be notified via Instagram and must send us a private message with the requested information within 48 hours. After that time, the winner will be disqualified and the first alternate will be chosen, and so on until the third alternate. This promotion is only valid in Spain. If the winner resides outside Spain, the first alternate will be chosen as the winner, and so on until the third alternate. If neither the winner nor the alternates respond, the prize will be forfeited.

5.- DISQUALIFICATIONS AND PENALTIES
If it becomes evident that any of the participants does not meet the requirements set forth in the Terms and Conditions, or if the information provided to participate is not valid, their participation will be considered null and void and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded under this Promotion.

6 – DISCLAIMER
By way of example, but not limited to, we are not responsible for any loss, theft, delay, or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use that the participant makes of the prize obtained from this Promotion.
We assume no responsibility in cases of force majeure or unforeseeable circumstances that may prevent the Promotion from taking place or the total or partial enjoyment of the prize.

7.- PROTECTION OF PERSONAL DATA
In accordance with the provisions of Organic Law 15/1999, of December 11, on the Protection of Personal Data, and its implementing regulations, each participant, by accepting these legal terms and conditions, consents to the personal data they provide being incorporated into a file, for which we are responsible, and used to send them newsletters and commercial and promotional communications related to our services by letter, telephone, email, SMS/MMS, or other electronic means of communication.
We inform you that you may exercise your rights of access, rectification, cancellation, and opposition by sending an email to contacto@funandbasics, attaching a copy of your ID card in both cases.

8.- CHANGES
We reserve the right to modify or extend these promotional terms and conditions, provided that this does not harm or undermine the rights of participants in the Promotion.

9. INTELLECTUAL PROPERTY
All designs submitted during the contest will become the property of funandbasics, which may use them for marketing purposes and include them in its own collection.

10- APPLICABLE LAW AND JURISDICTION
These legal terms and conditions shall be governed by Spanish law. The Courts and Tribunals of the city of Madrid shall have jurisdiction to resolve any claim or dispute that may arise in relation to the validity, interpretation, or fulfillment of these terms and conditions.
